Terms and Conditions
Introduction
Welcome to PetIt Terms and Conditions section. By installing or using PetIt app you agree to our Terms and Conditions because it is a contract between you and PetIt.
Eligibility
You cannot create an account or access or use PetIt Service or system it resides on unless you meet and follow the following criteria. You have to have at least 18 years old to use PetIt and not forbidden by the law from using this app. You can form a binding contract with PetIt. You also promise to follow this agreement and all applicable local, state, national and international laws, rules and regulations and that you are not a convicted person or hustler, animal abuser, animal smuggler, sex offender or any crime involving violence to human or animal.
Acceptance
By using PetIt, you agree to our Terms and Conditions, Privacy Policy and Safety Instructions. We may change to this agreement and the Service of PetIt. You can view the updated version of Terms and Conditions from the About section of the app that will lead you to the official website. If the changes to your rights or obligation that include material changes then we will notify you at least 30 days before the change is applied (unless we are unable to execute such under applicable law) through the notification feature of the Service. However, if you continue to use PetIt after the change that has become effective then you agree to the revised agreement.
Rules
When you use PetIt, you abide by the rules and regulations mentioned in Terms and Conditions, such as not soliciting money from other users, threat or harassing other users or using the Service for any illegal, harmful or even causing damage purpose to PetIt. You cannot impersonate any other person, stalk, infringe anyone’s right, promote hate speech, racism, bigotry, nudity, animal abuse, illegal animal trafficking or trade. You also cannot use other person’s account. Never use any kind of copyright content (Photo or Text) in PetIt or if found then we hold the privilege to ban your account or delete permanently.
Safety
PetIt is not responsible for the actions of its users or your interaction with them. PetIt does not conduct any background check of its users. So, please be cautious and check, read and follow the Safety Instructions while interacting with people. You are solely responsible for your interactions with other members. It is highly encouraged not to share your personal and financial information with others like password or bank account information.
User Account
When you are signing into PetIt by using Google, Facebook or Twitter, you have to authorize us to access some information of your account (e.g. your profile picture, your name and etc.) from these services above to be able to use PetIt. You agree that you keep your account confidential & secure. Also, you have to provide your geographical location for PetIt to work properly and show other users your post with the picture you have provided and also your location. Please check our Privacy Policy to know what information we collect from you and how we use it. By providing your coordinates to the Service you agree that PetIt can show your location to other users in the content and they get the idea how far you live and feel interested to contact you regarding your pet.
Quality of Pet
PetIt does not control the health or quality of the pets provided in the SERVICE. We do not check if the pet shown in the picture matches exactly in real life. It is considered to be the sole responsibility of the user to check and double check the quality or health or attributes or properties of the pet. If the user is not satisfied then user can cancel the deal any time. If the post is lying about the pet then users can report the post anytime and we will delete the post if it gets sufficient reports.
Quality of Deal
PetIt does not control the nature or behavior of its users. If the behavior of a user is nasty then users can cancel deal or report the post. If deals do not go accordingly as planned then PetIt is not responsible for the outcome. Users are sole respnsible for their own respective actions. If any misconduct done by a user then you can put complaint against another user or deal in our contact us section and we will delete the user's account.
It is highly encouraged to read our Safety Instructions to you and if you feel uncomfortable then you can cancel a deal.
Post Deal Period
PetIt does not control or regulate any part of any deal. The SERVICE merely makes two users to be able to communicate with each other. Any part of any deal is conducted by users and it is their responsibility. If a deal has been conducted and pet has been exchanged, if you want to return it to its old owner then it is the old owner's choice. Previous owner may or may not agree with your proposal.
Return Policy
PetIt is a communication SERVICE and it does not monitor, regulate or facilitate any part of a deal. It is the users responsibility of how they make a deal and fulfils it. Thus, PetIt does not have any kind of returning policy to maintain. It is understood that the users will conduct a fruitful deal and it is their responsibility to engage with a deal or reject it. After an exchange of a deal if the current owner of the pet wants to return and the old owner wishes to accept or reject then it is between them. PetIt is no way can be held responsible for this conduct. However, if you have any complaint against any user then you can send a complaint in our Contact Us section and if sufficient evidence is provided then we will delete the user's account.
It is highly encouraged to read our Safety Instructions before conducting any communication or deal.
Arbitration
This agreement explicitly contains a mandatory arbitration clause. By using our Service you agree that any disputes will be settled by arbitration. That you waive your right to a trial by judge or jury or to participate in a class action.
Governing the Law (Venue)
Bangladesh law applies to this agreement. For any disputes regarding to this agreement must be brought in Bangladesh.
Modification and Termination
We can modify or discontinue the Service of PetIt at any time. If you want, you can delete your account from the About section of the app and we reserve the right to delete your account for you if you violate our agreement or if we deem your inappropriate usage of the app or Service.
Usage
PetIt cannot always take the responsibility of how you use the app i.e. you need to make sure that your device stays charged to avail the Service, so if you fail to use the app properly then you are responsible for that action. PetIt is an internet based app so you may be charged for the data fees by your internet provider. That might also cause you to pay roaming data charges. By using PetIt you agree that you acknowledge these terms and use the app in a proper manner as it’s meant to use. If any problem occurred from the internet service provider or your device then PetIt is also not responsible for such happening. You cannot change your location while a deal is ongoing. We prohibit using any sort of VPN or provide any fake location. If such thing happens then PetIt is not responsible for such conduct. Users are solely responsible for this kind of activity.
Thus, make sure you do not contact them alone physically and read our Safety Instructions for more information.
Indemnity
You accept the fact that you agree to indemnify us for your actions on your use of the Service, your content or your violation of this agreement.
Limitation of Liability
To the extent as it is permitted by the law, we do limit our liability to you for certain kinds of damages for claims regarding to your use of the Service and the activities or conducts of other users and unauthorized access or use of your content. However, if the user fails to use the Service properly because of his/her limitation or if the limitation is of the third party service then PetIt is not responsible for that.
Third Party Services
PetIt may contain advertisements and promotions which is offered by third party services and links to external websites or resources. PetIt is not responsible for the availability or the lack of availability of external services or resources. If you interact with those then their terms will govern their relationship with you. PetIt uses Firebase, Firebase Crashlytics, Google Analytics for Firebase, AdMob, Google Play Store, Google, Facebook, Twitter services. By using PetIt you agree that you agree with the terms of services of the services mentioned above. PetIt is not liable for such third parties’ terms of use.
Rights
By the agreement, as it is authorized and permitted, PetIt grants you the right to use its Services. However, PetIt does not permit you to use the content outside the Service or use any robot, crawler, bot, scrapper, spider to fetch or send data to the Service or modify, adapt, sub-license, data mine, reverse engineer, upload virus and malicious code, forge the Service, contents published in the Service or our app. You cannot frame or mirror any part of the Service without written authorization of PetIt. You cannot use meta tags, code or any instance of PetIt app or any trademark, logo, trade name, service mark or slogan of PetIt to your professional use or even direct any person to any other website or service for any purpose. You are not allowed to probe, scan or test for vulnerability of our Service or any system or network. You cannot encourage or promote anything that breaks this agreement. Also, PetIt does not allow you to use the Service or any content contained in the Service for any commercial use without proper written consent from us. Please go through the full agreement to get the full list of actions you promise and agree not to take. You provide us the permission and right to display your profile and content to provide our Service and researching & developing new ones. While using PetIt you agree that you would be respectful and kind to other users that you interact. You understand and agree that if this term is violated that we can remove your content or account from the Service. You agree that our affiliates and third party partners may place advertisements in the service.
Copyright
If you believe that your content has been posted on our Service that violates your copyright then please feel free to send us a notice to our copyright section here.
However, you need to provide us certain information regarding the copyright content.
- A brief description of where the copyright content is located in the Service
- Description of the copyrighted work
- A written statement of you mentioning that you have the belief that the disputed content is unauthorized by the copyright owner, his agent or by the law
- A written statement that explains the above information is accurate and you are the copyright owner or you are authorized to act on behalf of the copyright owner, made under penalty of perjury
- Your contact information which includes address, telephone number & email address and identity of the copyright owner
- Physical or digital signature of the person who is authorized to act on behalf of the owner
User Content
PetIt reserves the right to review and remove the content that violates this agreement and that content is the sole responsibility of the user who posts it. We cannot guarantee that all of the contents will comply with this agreement. If you find any content that violates this agreement then please let us know here.
Disclaimers
The Service of PetIt that is provided “as is” and “as available,” we disclaim legal liability for the quality, safety or reliability of our Service. However, PetIt does not take any responsibility for any content that any user or third party posts, sends or receives through this Service. Any material or content that is uploaded or downloaded or otherwise obtained using this Service is accessed at your own risk. PetIt is meant to help establish a healthy communication among people so that they can exchange their pets and pets can find new homes and using this Service people and animals can live happily. If someone buy or sell animals using the Service then it is not our responsibility. A good citizen should abide by the law of his/her country so if it is allowed by the law of the user’s country then we have no problem with that but however PetIt is not meant for that purpose but if the law allows and as long as pets get new home and shelter and its new family, we won’t restrict it. It is the user’s responsibility to abide by their country’s law. PetIt does not take any responsibility of the quality of the animals or the communications of users. Users are solely responsible for their actions of what they share in the Service and what kind or quality of pets they trade or exchange using PetIt.
